1. What EnterLeads Is

EnterLeads is a B2B lead discovery and AI-assisted email composition platform based in Texas, United States.

You connect your own Gmail or Outlook account via OAuth and send emails from your own inbox. We are a tool and platform — not the sender of your emails. Think of us like a CRM with AI drafting built in.

Even in automation mode, you are the initiator. You connected your inbox, defined your target audience, configured your outreach parameters, and authorized automated sending. EnterLeads executes on your instructions but does not independently choose recipients or compose content without your rules.

The platform discovers businesses from publicly available sources including business directories (Google Maps, Yelp, BBB, Yellow Pages), government databases (state permits, professional licenses), publicly visible social media business profiles, job board listings, and company websites. Sources may change as the platform evolves. We only collect data from public sources and do not access content behind login walls.

2. User Responsibilities

When you use EnterLeads to send emails, you are the sender. That means compliance is your responsibility. Here's what you need to know:

  • You are responsible for CAN-SPAM compliance on all emails you send through the platform.
  • You must include a valid physical postal address in your outreach. We enforce this during onboarding.
  • You must honor opt-out requests promptly. CAN-SPAM requires compliance within 10 business days; best practice is within 24 hours. The platform automatically detects and honors most opt-out requests in real-time via AI reply classification. You are responsible for manually honoring any opt-outs the system doesn't catch.
  • You must not send deceptive, fraudulent, or misleading communications.
  • You must not use false headers or impersonate others.
  • In approval mode, you are responsible for reviewing and approving all AI-generated content before sending. In automation mode, you have pre-authorized automated sending based on your configured audience, templates, and settings, and you accept responsibility for all content sent on your behalf.
  • You must comply with applicable laws in your jurisdiction — CAN-SPAM for US, GDPR for EU, CASL for Canada, Spam Act for Australia.
  • You are responsible for ensuring your outreach targets are appropriate for your business.
  • Cold SMS is prohibited. TCPA requires prior express written consent for marketing SMS ($500–$1,500 per message penalty). The platform only uses SMS for authentication codes.

3. What's Explicitly Permitted

You are allowed to:

  • Send legitimate B2B outreach to publicly listed businesses.
  • Use AI-drafted emails as starting points — with your review in approval mode, or pre-authorized in automation mode.
  • Use automated sending when you have configured and authorized it. You remain the initiator — you connected your inbox, defined the audience, and enabled automation.
  • Export and use publicly sourced business data for lawful business purposes.
  • Search public records: permits, licenses, business directories, Google listings, Yelp profiles, BBB records.

4. What's Actually Prohibited

You may not:

  • Send deceptive or fraudulent communications.
  • Harass, threaten, or send abusive messages.
  • Impersonate another person or business.
  • Send to purchased lists not sourced through the platform.
  • Circumvent platform rate limits or safety controls.
  • Use the platform for illegal purposes.
  • Resell raw data exports without authorization.
  • Scrape behind login walls, bypass CAPTCHAs, or create fake accounts on third-party platforms.
  • Use the platform to send SMS marketing. Only transactional SMS for authentication is supported.
  • Exceed tier-based usage limits as defined in Section 7, including result limits, AI token budgets, scraper access, and feature restrictions.

5. AI-Generated Content Disclaimer

Email drafts are AI-generated suggestions, not final communications. Here's what that means:

  • AI is powered by third-party language models (Anthropic Claude, Google Gemini, and others). Content quality depends on available data.
  • In approval mode, you must review and approve all AI-generated content before sending — you are the sole initiator. In automation mode, you have configured your audience, approved your templates, and authorized the platform to send on your behalf. You remain responsible for all content sent automatically. You acknowledge that automated content is not individually reviewed before delivery.
  • EnterLeads is not liable for content you approve and send.
  • AI may occasionally produce inaccurate claims, fabricated details, or inappropriate suggestions. You are responsible for verifying all facts before sending.
  • AI-generated content is not legal advice, financial advice, or professional consultation.

6. Data Accuracy & Scraping Disclaimers

Data is sourced from public records, government databases, business directories, company websites, publicly visible social media business profiles, and job board listings.

  • We do not guarantee accuracy, completeness, or freshness of any data.
  • You must verify data before acting on it.
  • Business information changes frequently — leads may contain outdated contact info, closed businesses, or incorrect details.

Data risk levels by source:

  • Government databases — very low risk, meant for public access
  • Google Maps/Yelp APIs — low risk, authorized API usage
  • Business directories — low risk, public listings
  • Company websites — low risk, public pages only
  • Publicly visible social media business profiles — low risk, public profiles only
  • Job board listings — low risk, public postings

We respect rate limits on all sources and do not bypass access controls. EnterLeads does not sell, rent, or share your personal data or business profile with third parties. See our Privacy Policy for full details on data sharing.

7. Account & Billing

Pricing Tiers

  • Free — $0/mo. 50 results, 19 scrapers.
  • Pro — $49/mo. 500 results, 21 scrapers.
  • Business — $149/mo. Unlimited results, all scrapers, CRM, campaigns, API access.
  • Lifetime — $1,500 one-time. Everything in Business, forever. Limited to 25 spots.

AI Token Budgets

Free: 80K tokens/mo. Pro: 6M/mo. Business: 18M/mo. Lifetime: 18M/mo forever. Model selection affects cost — Haiku 1x, Sonnet 3x, Opus 5x.

Payment Methods

Stripe (cards, Apple Pay, Google Pay, Klarna Pay Later) and PayPal.

Auto-Renewal

Subscriptions auto-renew. We send a renewal reminder 7 days before each charge.

Cancellation

Cancel anytime online. Self-service cancellation from your dashboard with minimal steps. No phone call required. No hidden barriers. Your access continues until the end of your billing period.

Pause Option

You can pause your subscription for 1–3 months instead of canceling. Your data is retained indefinitely during the pause, and you can resume with one click. If you do not resume before your pause period ends, your subscription auto-converts to cancelled status and standard cancellation terms apply (data retained for 2 years).

Refund Policy

  • 14-day satisfaction guarantee on all plans — full refund, no questions asked.
  • After 14 days: Monthly plans receive a full refund for the current billing period. Annual plans receive a pro-rata refund for unused months. Lifetime is non-refundable.
  • Refunds are processed to your original payment method within 3–5 business days.

Refund Abuse

Refund requests are processed generously. After repeated refund requests indicating a pattern of abuse, future subscriptions may be restricted. We track this by account ID, payment card fingerprint, and IP address.

Payment Failure

Failed payments are automatically retried. If payment continues to fail, we send multiple email notifications over a 7-day grace period before suspending access. Repeated payment failures across billing cycles may result in auto-downgrade to the free tier.

Lifetime Spots

Limited to 25 total. When sold out, no more lifetime purchases are available.

8. Termination & Account Closure

Subscription Cancellation (Stop Paying, Keep Account)

Cancel anytime. Access continues until your billing period ends. Your account and all data are retained for 2 years after your subscription ends. You can resubscribe at any time during this window and pick up exactly where you left off — all leads, chat history, pipeline results, CRM contacts, and settings are preserved. After 2 years of inactivity with no resubscription, your account enters the deletion process.

Account Deletion (Erase Everything)

You can request full account deletion. You will be notified via email at each stage:

  • Days 1–7: Cooling-off period. Full access. You can undo the request. We email you a confirmation with an undo link.
  • Days 8–37: Data export window. Read-only access. We email you a reminder to export your data before it's gone.
  • Day 38: Soft delete. We email you: "Your data has been removed. This is irreversible."
  • Day 90: Hard delete. All data permanently destroyed.

Inactivity Closure

12 months inactive — we send a warning email. 24 months — the closure process begins.

Violation Termination

We can suspend or terminate your account for Terms of Service violations immediately. Serious violations (fraud, harassment, illegal use) result in immediate termination with no refund.

Post-Termination Data

What happens to your data depends on how your account ended:

  • Subscription cancelled (no deletion request): All data retained for 2 years. You can resubscribe and restore full access.
  • Account deletion requested: Pipeline leads, email history, dossiers, and contacts deleted within 90 days per the process above.
  • Financial records: Retained 7 years regardless (tax law).
  • Suppression records: Retained permanently to prevent re-contacting opted-out contacts.

Chargeback Consequences

  • 1st chargeback — logged and monitored.
  • 2nd chargeback — blocked from future subscriptions.
  • Pattern of friendly fraud — reported to industry fraud databases where available and permanently banned from the platform.

9. Limitation of Liability

To the maximum extent permitted by law, EnterLeads is not liable for indirect, incidental, or consequential damages. Specifically, we are not liable for:

  • Email deliverability outcomes, spam filter placement, or recipient responses.
  • Actions taken by email providers (Gmail throttling, account suspension, OAuth revocation).
  • Data accuracy — business information sourced from third parties may be outdated or incorrect.
  • AI-generated content that you approved and sent.
  • Third-party service outages (Nylas, Stripe, PayPal, Google Maps API).

Our total liability is capped at the greater of (a) the amount you paid us in the 12 months before your claim, or (b) fifty dollars ($50).

10. Indemnification

You agree to indemnify and hold harmless EnterLeads for claims arising from:

  • Your violation of any obligation in Sections 2, 3, 4, and 5 — including CAN-SPAM, GDPR, CASL, and TCPA violations.
  • Emails sent through the platform on your behalf, whether sent manually after your approval or automatically under your configured automation settings.
  • Misuse of exported data.

11. Intellectual Property

  • EnterLeads owns the platform, algorithms, AI models (via third-party providers), and underlying technology.
  • You own your business profile data, email drafts you've edited, and exported lead lists.
  • AI-generated email drafts become your content once you review and approve them.
  • You grant EnterLeads a license to process your data for service delivery.
  • Publicly sourced business data is not owned by any user — it's a shared pool.

12. Email Communication Compliance

Our email communication and compliance practices — including consent management, opt-out mechanisms (cold outreach vs. automated sequences), preference center, consent expiry, suppression enforcement, and SMS/TCPA compliance — are described in detail in our Privacy Policy Section 12.

By using our platform, you agree to those practices. Key points:

  • First-touch B2B outreach does not require prior consent under CAN-SPAM (opt-out model).
  • Automated sequences include unsubscribe links.
  • All opt-out requests are honored permanently.
  • SMS is used only for authentication.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, United States.

If you are located outside the United States, this choice of law does not deprive you of the protection of mandatory consumer protection, data protection, or anti-spam laws of your country of residence that cannot be waived by contract.

Disputes are resolved through binding arbitration, except for claims that qualify for small claims court.

Class action waiver: Disputes are handled individually, to the maximum extent permitted by applicable law. This waiver does not limit rights that cannot be waived under your local law, including collective redress rights under GDPR Article 80, the EU Representative Actions Directive (2020/1828), and equivalent UK GDPR provisions. Where applicable law prohibits waiver of collective redress, such claims will be resolved in the courts of competent jurisdiction in the claimant's country of residence. The remaining provisions of this dispute resolution section continue to apply to all other claims.

Before formal proceedings, both parties agree to a 30-day informal resolution period.

14. Changes to Terms

We will give you 30 days advance notice via email for any material changes to these Terms.

Non-material changes (clarifications, formatting, typo corrections) may be made without advance notice.

For clarity, the following are always considered material changes requiring 30-day notice: changes to pricing or billing terms, data sharing or data retention practices, user rights, liability limitations, indemnification obligations, arbitration or dispute resolution terms, and the addition of new third-party services that process user data.

Continued use after the notice period means you accept the changes. You can cancel without penalty if you disagree.
